Terms and Conditions of Sale
- Acceptance of Terms
By placing an order with Bravo Aviation, you (“Customer”) agree to the following terms and conditions. These terms govern the sale of aircraft parts (“Products”) provided by Bravo Aviation (“We”, “Us”, “Our”). Any deviation from these terms will only be valid if expressly agreed upon in writing by Bravo Aviation.
- Order Placement and Acceptance
All orders placed with Bravo Aviation are subject to acceptance and confirmation. Upon placing an order, you will receive an order acknowledgment email confirming the details of your order. This email does not constitute an acceptance of the order. Bravo Aviation reserves the right to reject any order for any reason, including but not limited to product availability, incorrect pricing, or shipping restrictions. Rejections as such will be communicated by Bravo Aviation in writing.
- Payment Terms
- Pricing: All prices communicated to the customer in any quotation are subject to change without notice and are exclusive of applicable taxes, shipping, and handling fees.
- Payment Method: Payment must be made in full via bank transfer, or other methods explicitly agreed upon by Bravo Aviation.
- Payment Due: Payment must be received before the due date specified on the supplied invoice.
- Product Availability and Supply
- OEM Sourcing: Bravo Aviation orders products directly from Original Equipment Manufacturers (OEMs) or authorized factories and resells them to customers. As such, product availability depends on the OEM’s production schedule and inventory status.
- Backorders: In the event a product is out of stock or backordered, Bravo Aviation will notify the customer promptly. The customer will have the option to cancel the order or wait for the product to become available.
- Product Substitution: If a product is unavailable, Bravo Aviation may offer a suitable substitute, subject to the customer’s approval.
- Shipping and Delivery
- Drop Shipping: All orders are drop-shipped directly from the OEM/factory to the customer, which may result in delivery from multiple locations.
- Shipping Costs: Shipping charges will be added to the total order price. Shipping costs vary depending on the delivery location and the size of the order.
- Delivery Time: Delivery times are estimates and may vary depending on the manufacturer’s availability and shipping carrier. Bravo Aviation will not be held responsible for any delays caused by the OEM or third-party carriers.
- Risk of Loss: Once the product is shipped, the risk of loss or damage during transportation is transferred to the customer.
- Return and Cancellation Policy
- Order Cancellation: Orders may be canceled within 24 hours of placement, subject to approval, and if the product has not been shipped. After this time, cancellations will only be accepted at the discretion of Bravo Aviation.
- Returns: Products may only be returned if they are defective, damaged upon arrival, or incorrectly shipped. Returns must be initiated within 30 days of delivery and must be accompanied by the original packaging and proof of purchase.
- Restocking Fees: Returns that are not due to error on the part of Bravo Aviation may be subject to a restocking fee of up to 20%.
- Non-returnable Products: Custom or special order parts are non-returnable unless they are defective or incorrectly shipped.
- Warranty
- Manufacturer’s Warranty: All products are covered by the manufacturer’s warranty, if applicable. Warranty terms will vary depending on the OEM/factory. Bravo Aviation does not provide an independent warranty on products sold.
- Claims: Customers are responsible for submitting warranty claims directly to the OEM or manufacturer. Bravo Aviation will assist with the process but is not liable for warranty claims or the outcome.
- Limitation of Liability
Bravo Aviation is not responsible for any damages, losses, or expenses arising from the use or inability to use the Products, including but not limited to direct, indirect, incidental, or consequential damages. The total liability of Bravo Aviation in connection with any order will not exceed the amount paid by the customer for the Products.
- Force Majeure
Bravo Aviation will not be held liable for any failure or delay in the performance of its obligations under these terms due to any cause beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor strikes, or delays by OEMs or shipping carriers.
- Customer Responsibilities
- Correct Information: The customer is responsible for providing accurate information regarding shipping addresses, product details, and payment information. Bravo Aviation is not liable for issues caused by incorrect or incomplete information provided by the customer.
- Compliance: The customer agrees to comply with all applicable laws, regulations, and export control requirements when purchasing, receiving, and using the Products.
- Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms will be resolved through binding arbitration, conducted in Amsterdam, in accordance with the rules of the Netherlands Arbitration Institute (NAI). In the event of a dispute, the courts of Amsterdam, the Netherlands, shall have exclusive jurisdiction.
- Intellectual Property
All intellectual property, including trademarks, logos, and content on the Bravo Aviation website, are the property of Bravo Aviation or its licensors. Unauthorized use of such intellectual property is prohibited.
- Modifications to Terms and Conditions
Bravo Aviation reserves the right to modify or update these Terms and Conditions at any time. Customers will be notified of any material changes, and such changes will apply to all orders placed after the effective date of the update.
